Terms of Service

These Terms of Service ("Terms") govern your access to and use of TopicalDrift.com ("Topical Drift", "we", "us"). By using the site or the app, you agree to these Terms.

Who can use the service

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Accounts and security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for activity that occurs under your account.
  • You agree to notify us promptly if you suspect unauthorized access or misuse.
  • Sharing accounts or credentials is prohibited unless you have a multi-user plan.

Service description and beta status

Topical Drift provides semantic drift and internal-link mismatch analysis using:

  • Sitemap crawling and main-content extraction
  • High-dimensional embeddings (sentence transformers)
  • UMAP semantic projection for 2D visualization
  • K-means clustering for topical grouping
  • Internal link context analysis (anchor + surrounding text + container)
  • Google Search Console (GSC) performance data integration (optional)
  • Interactive radial visualization with customizable parameters
  • Linking opportunity detection (semantic neighbor analysis)

Beta status:

  • Beta: During beta, features may change, be removed, or behave inconsistently.
  • Limits: Beta scans are subject to page limits (up to 500 pages per site) but include unlimited scans with fair use policy (see below).
  • No guarantees: We do not guarantee rankings, traffic, revenue, or any particular outcome.
  • Service availability: We aim for high uptime but do not guarantee uninterrupted service, especially during beta.

Unlimited scans fair use policy

All plans include unlimited scans subject to this fair use policy. "Fair use" means reasonable usage for legitimate site analysis, not abuse or reselling access.

✅ Fair use includes:
  • Weekly scans during content updates/projects
  • Before/after scans to test fixes
  • Ad-hoc scans when traffic drops
  • Comparing different strategies
  • Monthly maintenance scans
❌ Not fair use:
  • Automated high-frequency scanning (hourly/every few minutes)
  • Reselling or redistributing scan access
  • Abuse or attempts to overload the system
  • Commercial scraping or data harvesting
  • Scanning sites you don't own/manage

Typical usage: Most users scan 1-2 times per month. Scanning weekly during projects or testing is fine. We reserve the right to limit access if usage patterns indicate abuse or create service degradation for other users.

Your inputs and permissions

You are responsible for ensuring you have the rights and permissions to provide any websites, sitemaps, data, or files ("Inputs") to the service.

  • You represent that your Inputs do not violate applicable laws or third-party rights.
  • If you connect GSC, you represent you have authorized access to the selected property.
  • You grant us a limited license to process Inputs solely to provide the service (generate embeddings, analyze content, create reports, exports, and visualizations).
  • You are responsible for ensuring crawled sites allow automated access per their robots.txt and terms.

What you can't do

You agree not to misuse the service. Prohibited activities include:

  • Attempting to access systems or data you are not authorized to access.
  • Interfering with or disrupting the service (including automated abuse, excessive API requests, or high-frequency scanning designed to overload systems).
  • Reverse engineering, scraping, or extracting the service in a way that violates these Terms or applicable law.
  • Using the service to violate laws, infringe rights, or distribute malware.
  • Reselling or white-labeling access unless we explicitly agree in writing (Enterprise plans may include white-label rights).
  • Creating multiple accounts to circumvent fair use or plan limits.
  • Sharing account credentials or API keys with unauthorized parties.
  • Using the service to scan sites you don't own or have permission to analyze.

Reports, exports, and decisions

The service provides analysis outputs such as:

  • Actual and normalized semantic distance measurements
  • UMAP semantic projections and angular positioning
  • Drift scores and zone classifications
  • Cluster membership and overlap analysis
  • Internal-link mismatch flags and similarity scores
  • Linking opportunity recommendations
  • Interactive visualizations and exports
  • Suggested actions and prioritized checklists

Important disclaimers:

  • Outputs are informational and should be validated by you before you implement changes.
  • SEO is dynamic; outcomes depend on many factors outside our control (site changes, competition, search behavior, algorithm updates).
  • Embeddings and UMAP projections are mathematical models that approximate semantic meaning; they are not perfect representations.
  • You are responsible for decisions and actions you take based on Outputs.
  • We do not claim access to Google's internal ranking algorithms or scoring systems.

Data processing and retention

What we store:

  • Page embeddings (high-dimensional vectors)
  • UMAP projection coordinates
  • Analysis results (drift scores, clusters, linking opportunities)
  • Aggregate metrics and statistics
  • Historical scan data (depending on your plan)

What we don't store:

  • Full raw HTML of your pages
  • Complete query lists from GSC (only aggregate data)
  • User passwords (we use industry-standard hashing)

Retention: Historical data is retained according to your plan (Starter: no history, Professional: 6 months, Agency: unlimited). You can request deletion of your data by contacting us. See our Privacy Policy for details.

Intellectual property

  • Our IP: The site, app, software, design, branding, UMAP implementation, embedding models, clustering algorithms, and underlying methodology are owned by Topical Drift (or its licensors) and are protected by copyright, trademark, and other intellectual property laws.
  • Your IP: You retain ownership of your Inputs (site content, data). Subject to these Terms, you own your Outputs (reports/exports/visualizations) generated for your account.
  • Limited license: We grant you a non-exclusive, non-transferable license to use the service and your Outputs for your internal business purposes.
  • Feedback: If you submit feedback, feature requests, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction to improve the service.
  • Open source: Some components use open-source libraries (UMAP, sentence transformers, etc.) which retain their respective licenses.

Plans, billing, and refunds

During beta, the service is free. If and when paid plans are offered:

  • Plan limits (sites/pages) will be defined on the pricing page or within the app. All plans include unlimited scans (fair use).
  • Subscriptions (if enabled) renew automatically unless canceled.
  • Taxes may apply depending on your location.
  • Refunds: We offer a 30-day money-back guarantee. If you're not satisfied within the first 30 days, contact us for a full refund. After 30 days, cancellation stops future billing but we don't refund past charges.
  • Upgrades: Take effect immediately with prorated billing.
  • Downgrades: Take effect at your next billing cycle.
  • Overages: If you exceed page limits, we'll notify you before charging any overage fees.
  • Beta pricing: Beta users who convert to paid plans will receive grandfathered "founding member" pricing.

No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL PRODUCE ANY PARTICULAR RESULT (INCLUDING IMPROVED RANKINGS, TRAFFIC, OR REVENUE). WE DO NOT WARRANT THAT EMBEDDINGS, UMAP PROJECTIONS, OR CLUSTERING WILL BE 100% ACCURATE OR FREE FROM ERRORS. YOU USE THE SERVICE AT YOUR OWN RISK.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 3 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Termination

  • You may stop using the service at any time by canceling your account.
  • We may suspend or terminate access if you violate these Terms (including fair use policy), create risk, misuse the service, or fail to pay fees.
  • Upon termination, your right to use the service ends immediately.
  • You may export your data before termination; after termination, we may delete your data per our retention policy.
  • Certain provisions (IP, disclaimers, liability limits, dispute resolution) survive termination.

Privacy

Our Privacy Policy explains how we collect, use, store, and protect information (including embeddings, UMAP data, and analysis results). By using the service, you agree to the Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above. If changes are material, we will provide additional notice (such as a banner, email, or in-app notification). Continued use of the service after changes take effect constitutes acceptance of the new Terms.
